The Dangerous Waterslide

During the visit to Typhoon Lagoon in 2019, Emma McGuinness, her daughter, and her mother took a ride on the Humunga Kowabunga, a 200-foot waterslide where riders cross their legs at the ankles before descending five stories in the dark before landing in a pool of water.

Failed To Cross Legs

The suit, filed by McGuinness and her husband, Edward, claims riders were not told why their ankles needed to be crossed or the risks of injury if their ankles became uncrossed.

Additionally, they allege that riders are not informed that the force of the water in the pool can push loose garments into a person’s anatomy, known as a ‘wedgie.' The lawsuit says that due to a woman's anatomy, the risk of a painful wedgie is more common and serious than it is for a man.

Permanent Injuries

McGuinness allegedly became airborne toward the end of the slide, leading to a hard landing in the pool, which required hospitalization for serious injuries. She now has permanent injuries, including damage to her internal organs, scarring, and mental anguish, resulting in loss of enjoyment of life, expensive medical care, and loss of earnings, which are permanent or continuing in nature.

The couple is demanding at least $50,000 in damages, alleging that the slide is "unsafe and unreasonably dangerous" and that Disney was negligent for not advising riders of potential risks or the need to wear garments that prevent wedgies.

As of now, Walt Disney World has not commented on the lawsuit.
